حول تنظيم جمعية عدالة من أجل الحق في محاكمة عادلة للندوة المغاربية في موضوع "الحماية القانونية والقضائية للحقوق والحريات" بالمنتدى الاجتماعي العالمي بتونس 2015

في إطار مشاركة جمعية عدالة في المنتدى الاجتماعي العالمي بتونس نظمت  يوم الجمعة 27/3/2015 ندوة مغاربية تحت عنوان

"الحماية القانونية والقضائية للحقوق والحريات "

تمحورت هذه الندوة  حول:

 -إشكالية  الولوج للعدالة بالنسبة للفئات الهشة:تأطير ذة هدى الحبوشي محامية بتونس
- الحماية القضائية ضد التمييز :تأطير ذة كلثوم كنو رئيسة جمعية القضاة بتونس  
- الحماية القضائية ضد التعذيب :تأطير  ذ محمد الهيني عضو المكتب التنفيذي لجمعية عدالة

و تكلف بتسيير الندوة  ذ سعيد خمري نائب رئيسة جمعية عدالة من أجل الحق في محاكمة عادلة ،وخلصت المداخلات العلمية التي قدمها الخبراء المغاربيين والتي أثرتها النقاشات القيمة والمستفيضة للجمعيات والمنظمات الحقوقية المغربية والدولية إلى إقرار عدد من   التوصيات المهمة نذكر منها :

1-تأسيس مرصد مغاربي للعدالة وحماية الحقوق والحريات
2-التعجيل بإصدار النصوص التنظيمية للمحاكم الدستورية المغاربية وللدفع بعدم دستورية القوانين لضمان مراقبة فعالة على التشريعات المتصلة بحماية الحقوق والحريات 
3-تقوية استقلال القضاء رئاسة ونيابة عامة عن السلطة التنفيذية وتعزيز دوره وضمان تخصصه  لحماية الحقوق والحريات 
4-تحسين الولوج للقضاء بتطوير نظام المساعدة القانونية والقضائية للفئات الأكثر هشاشة 
5-تقوية جانب الوقاية والزجر لمناهضة التعذيب وإلحاق الشرطة القضائية بأجهزة السلطة القضائية
6-تسريع وثيرة ملاءمة  القوانين الوطنية مع  المواثيق الدولية لحقوق الإنسان

وهكذا تم الوقوف على واقع الحماية القضائية للحقوق والحريات الأساسية، بغاية  المساهمة في نشر ثقافة حقوق الإنسان، والتعريف بدور السلطة القضائية في حماية الحقوق والحريات، وتوضيح القوانين والمساطر المعتمدة في ذلك، والمساهمة في توفير المعلومة ونقلها لكل المعنيين من سلط دستورية ومؤسسات قضائية ومؤسسات وطنية مستقلة وهيئات حقوقية وكافة المواطنات والمواطنين، فضلا عن تكريس الحق في الحصول على المعلومة الحقوقية والقانونية والقضائية.

وساهمت الندوة في تكريس  النقاش العمومي المغاربي والدولي حول المساهمة  المدنية في إرساء قواعد دولة الحق والقانون والتي لن تتحقق إلا من خلال توفر العديد من الشروط والضمانات، ومن أهمها استقلال السلطة القضائية عن وزارة العدل والنهوض بدورها في حماية الحقوق والحريات وفي ضمان الأمن القضائي والقانوني.

وبكل تأكيد فمن خلال مختلف هذه الأهداف، تبقى الغاية الأساسية هي الوصول لتكريس ولوج شفاف للعدالة وحماية حقيقية كافية وفعالة لمختلف الحقوق والحريات ، ووضع حد للانتهاكات الماسة بها، وإنزال العقوبات في حق كل من يخرقها.

During the Adala Association’s participation in the World Social Forum in Tunis on 26/3/2014 at the Maghrebian Symposium under the title “legal and judicial protections for rights and freedoms,” the symposium focused on:

- The problem of access to justice for marginalized groups: presenting on this was Huda Al-Hubushi, a lawyer from Tunisia.

- Judicial protection against discrimination: presenting on this was Kulthum Kanu, the Chief Associational Justice from Tunisia.

- Judicial protection against torture: presenting on this was Mohammed Al-Heina, member of the Executive Office for the Adala Association.

The obligation for conducting the seminar belonged to Sayed Khamri, the Vice-President of the Adala Association. It concluded with scientific presentations given by North African experts, raising valuable and extensive discussion on associations and human rights organizations, Moroccan and international, towards the adoption of a number of important recommendations, among which were:  

1) Establishing a North African Observatory for justice and the protection of rights and freedoms.

2) Accelerating the publication of regulatory texts for North African constitutional courts and to challenge unconstitutional laws to ensure effective monitoring of legislation related to the protection of rights and freedoms.

3) Strengthening the independence of the chief judiciary on behalf of the public from the executive branch and to strength its role to ensure, especially, the protection of rights and freedoms.

4) Improving access to justice for the development of a system of legal and judicial assistance to the most marginalized groups.

5) Strengthening prevention and condemnation against torture, and firmly placing the judicial police under judicial power.

6) Accelerating the pace of harmonization of national law with international human rights laws and conventions.

Thus, by standing on the reality of judicial protection for rights and basic freedoms, we do the utmost to contribute to a culture of human rights, defining the role of judicial power in the protection of rights and freedoms, clarifying the laws and rulers approved for it, contributing to the provision of information and the transfer of concerns for constitutional authority, judicial institutions, independent national institutions and human rights bodies, for all citizens, as well as to dedicating ourselves to the right to access legal, judicial and human rights information.

The seminar contributed to the North African and international public discussion about civil society’s contribution towards establishing the rule of law, which can only be achieved through the provision of several conditions and guarantees, the most important of which is the independence of the judiciary from the Ministry of Justice and the advancement of its role in the protection of rights and freedoms in order to guarantee judicial and legal security.

Certainly through these various objectives, the basic goal remains the dedication to transparent access of justice and the effective protection of all various rights and freedoms, and to put an end to abuses of them, and to impose penalties against all those who violate them.
